Join Rosalind Lake and Priyanka Naidoo on 8 May 2020 for a webinar where they will be discussing “Protecting of Personal Information (POPI) in the insurance sector.

The COVID-19 outbreak has highlighted the importance of protecting individual personal information. Although the Protection of Personal Information Act, 2013 (POPI) is not yet fully in force, the Information Regulator has issued guidelines for the protection of personal information during the outbreak essentially asking everyone to voluntarily comply with its provisions.

Many companies have already elected to proactively comply with POPI simply because it makes good business sense to both safeguard their reputation and to mitigate what can be substantial organisational risks, for example data breaches. We have even seen financial service authorities proactively engaging with FSPs in relation to cyber breaches and possible risk to personal information in the sector. We are noticing significant increases in data breaches and with many employees working remotely there is even more possible exposure and hackers are taking advantage of possible gaps.

Although the Information Regulator does not yet have enforcement powers, parties across all sectors have already been voluntarily engaging with the regulator on breach incidents because of the reputational and other risks. There will be a one-year grace period to comply fully after POPI’s commencement. With the advantage of time on your side, you should be considering your company’s approach to compliance, and how much time and resources you will need to comply with POPI in time. During this segment, our data protection experts will talk you through the ins and outs of POPI, as well as deal with practical considerations for your company’s compliance with POPI.

Rosalind is a director in the business law team and specialises in competition, consumer protection and data privacy law. Rosalind is well-known for her pragmatic and business orientated advice that assists to manage regulatory risk.

Rosalind advises on data privacy compliance and managing and responding to cyber-attacks. She is currently assisting a large number of South African and global entities to align their practices with data privacy laws, best practice and to respond to cyber emergencies. Rosalind is highly skilled at regulatory investigations, compliance audits and developing sustainable compliance programmes.

Rosalind has substantial experience in cartel investigations, leniency applications, merger notifications and competition and consumer protection law opinions across all sectors and on a pan-African basis.

Priyanka Naidoo
Priyanka is an associate designate in the business law team and specialises in technology law. Her interest areas include cyber and data risk, data and information privacy, and data and information security.
Priyanka’s experience involves providing advice and services to clients in transactional and dispute-related areas including: cyber risk policy response, data breach incidents, investigation of computer fraud, negotiations in outsourcing agreements, negotiations in software licensing agreements, compliance with multi-jurisdictional data protection legislation (including Protection of Personal Information Act and the EU’s General Data Protection Regulation), the appropriate use of cookies, and various online business activities.
