Overview
At claims stage disputes frequently arise between insurers and insureds regarding the measure of the indemnity to be paid. The calculation of the indemnity payment is often a difficult one. In property insurance, reinstatement value conditions encourage the insured to reinstate the property and provide the insured with the benefit of receiving the value of new property in place of old property.

Daniel specialises in insurance litigation and advice, marine and non-marine transport disputes, and commercial litigation.

Peter Rogers is an associate in the dispute resolution and insurance litigation team of Norton Rose Fulbright, based in Cape Town.
Peter focuses his practice on professional indemnity claims and subrogated recoveries. He has acted in a number of large actions involving professional negligence claims against financial advisors, liquidators and civil and chemical engineers. He has also acted in maritime insurance disputes.
