A Guide to Indemnity and Reinstatement Value Conditions

21 May 2020 The Insurance Institute of South Africa

Overview
At claims stage disputes frequently arise between insurers and insureds regarding the measure of the indemnity to be paid. The calculation of the indemnity payment is often a difficult one. In property insurance, reinstatement value conditions encourage the insured to reinstate the property and provide the insured with the benefit of receiving the value of new property in place of old property.

This session will discuss volume 3 of Norton Rose Fulbright’s Big Read Book which can be found at https://www.financialinstitutionslegalsnapshot.com/wp-content/uploads/sites/161/2019/12/The-Big-Read-Book-series-Volume-3-A-guide-to-indemnity-and-reinstatement-value-conditions.pdf and will discuss recent case law on the subject of indemnity payments and reinstatement value conditions.
