Policy Exclusions with Respect to Defects in Design, Materials and Workmanship.

Contract works insurance provides protection against the risk of damage or destruction of the works, during the construction period. But the policies generally contain exclusions in respect of defects in design, materials and workmanship. What constitutes damage or destruction of the works as opposed to defects in the works, in the context of remedial works claims? This is often hotly debated and has given rise to a body of reported decisions in the Commonwealth jurisdictions.
